If an american marries a person for a different country so that they other person can become a citizen. Can the american get sent to jail if caught?

  1. No, but it is no longer such a simple thing as marrying an American and automatically becoming a citizen. If you get married, Customs and INS can still deport the person if they did not enter the country by the proper means. You should be okay, but why marry someone when it will not work?


  2. First of all, the foreign person does not automatically become a citizen.  Secondly, yes, it is illegal to do that.

If an American citizen marries a non-citizen for that person to obtain immigration benefits, that's marriage fraud.  The US citizen is subject to 10 years in prison plus $250,000 fine.  The non-citizen has any visa, green card, even naturalization revoked and is deported and permanently barred from the US.  Certain circumstances automatically trigger a marriage fraud investigation these days because the incidence of this is enormous.  So forget the "if I get caught..." disclaimer.  You're not just going to get caught, you're going to jail for a l-o-n-g time.
