What are the chances of being sent back to one's home country if one got married in the U.S. to an American citizen without a Fiance Visa (as a visitor)????????????

  1. Getting married is legal. Getting married and changing status (trying to stay in US) on a visitor visa is considered prima facie evidence of visa fraud. The USCIS assumes you came with the intention of getting married and changing status.


  2. If she came here as a tourist/visitor, then she has no other choice but to go back to her country. You can then start the process of petitioning her as a spouse using the K-3 or CR1. Only those with Fiancee visas or K-1 are allowed to get married and stayed here in the US and eventually file to Adjust their status because that was the main purpose of the visa.   4. You seem to be asking this question over and over in the hope that someone will tell you what you want to hear. You know as well as the rest of us that you need a fiance visa. You shouldn't expect a miracle to come along and wipe out that requirement.

    The purpose of your trip to the U.S. is to get married, not to visit. The documents presented must be compatible with ones purpose and intent.

    An alien coming to visit, needs a visitors visa or admission under the VWP. An alien coming to marry and live in the U.S. needs a finace visa. This has been true for decades.

    It depends. If you got married almost immediately after your arrival I see no problem, you must show that your marriage is bona-fied. Check your I-94 (the white paper they gave you at your arrival) to see when you had to leave the country. If you over stayed you are granted 180 days after the expiration date.

    You can call USCIS and they will tell you the same.

    You don't need a Fiance Visa to marry. Simply make sure that you show evidence that your marriage is for love and not for documents.

  6. Basically your case is hopeless since you have a daughter whose father is the man you would be marrying.

    If you get married on your visitor visa or on the VWP and then attempt to adjust status, you will definitely get in trouble.

    US immigration authorities will look at your application for a green card, note that you entered the US on a visitor visa with your daughter and married her father, and then attempted to adjust status.

    Remember that you have to prove you did not have any intention to marry when you entered the US. When you enter on a tourist visa with the daughter of the man you're marrying, that's pretty suspicious.

    There are cases where it's feasible. Your case is clearly a bad idea without the proper visa.

    Don't risk it or you're exposing yourself to no end of trouble for yourself and your family.
