If you're married part of the year, does your filing status depend on whether you were still married on Dec 31? Or is it more like you're considered married for the year if you were married during any part of the year?

  1. Usually, the status on December 31.  If you, say get divorced on December 24 and remarried on January 7, the IRS may decide the divorce was a sham, and decide you were married at the year's end.  


  2. Your marital status as of 12/31 determines your filing status for that year.

  3. Your status as of the end of the day on 12/31 determines whether or not you file as married for the year.

  4. Your marital status is determined as of December 31, 2008.  If you received a divorce prior to the end of the year, you are considered unmarried for the entire year.

    If your spouse dies during 2008, you are still considered married for 2008, as a surviving spouse.


  5. You are married for a year if you are married on Dec 31 of that year.
