Massachusetts claim law? Auto accident MA driver and NH driver? Called 90/10claim law?

Has anyone heard of a 90/10 claim law in Massachusetts.

MA driver and NH driver hit, MA driver at fault. NH driver, no insurance. Claim adjuster stated there is a 90/10 law because of how the NH driver struck the MA driver in the back corner of vehicle.

So NH driver pays 10% of the damages he has and the MA insurance company pay's 90% of the NH drivers claim?

  1. OK, so did the accident happen in MA, or NH?

    In MA, ALL vehicles are required to carry liability insurance, even NH vehicles.  Yes, I know, NH doesn't require liability insurance.  But the second this guy drove over the state line, he was illegal.  

    MA, last I heard, was a 51% state.  That comparative liability bit you're being quoted, sounds like NH law.

    But the law applies, for whichever state the accident happened in.  

    The thing to worry about, is if the MA driver is 90% at fault, they pay 90% of the damages to the NH driver.  But then the NH driver pays 10% of the damages to the MA driver.

    But it sounds like the NH driver should be the 90% at fault guy .  . then the MA insurer, would pay 10% of the damage to the NH car, and the NH car would pay 90% of the damage to the MA car.  

    See, not having insurance, ALSO means, you're completely at the mercy of the other guy.  AND, you don't have any legal experts to turn to, except a bunch of anonymous yahoos.
