Question:

Maternity leave?

I know under FMLA law you can take up to 12 wks off for maternity leave. I also have short term disability insurance which will pay up to 26 wks. My employer tells me that I can only collect up to 12 wks of short term pay because that is how long I can take off according to FMLA law. I'm sure I can take off longer than 12 wks if I can get a note from my doctor requiring me to be off longer. Has anyone been able to get their doctor to do this for them and what excuse was used to extend your leave of absence?

  1. you generally have to have a valid medical reason to extend your maternity leave. if not that is insurance fraud and your doctor could lose his lisence to practice both of you could possibly go to jail if the prosecutor decided to do so. definitely not worth it.
