Me and another car bumped in my school parking lot while backing out, whose fault ?

so, i was backing out a parking space, i checked in my rearview mirror and turned back, no cars, no people and pulled out at normal speed, and as i was doing so, i heard this crack and i was like c**p. i parked, got out, and i saw this car that backed out right behind be nailed me right in the left side corner of the bumper. when we got settled and re parked, i looked at his damage, and i hit kind of above his right side, back wheel and when he pulled out of the accident it kind of scraped him and my car. there was less damage to his car, and way more to mine, but whose fault?

i mean yea he was was telling me it was my fault because since i hit him not in the bumper and more on the side it was my fault, but under the circumstances i think we both tried to go first and he just pulled out faster than me.

im 17 and this is my moms car and im on her insurance, but whats going to happen? i heard theres such thing when both people are blamed for it, does this go on my record?

  1. Well I'm kinda thinking here.

    Did his reverse lights work?

    I find it odd that you wouldn't have see them when looking back before you pulled out.

    If so, you could blame him for not having working lights.

    It's a long shot, but could work.


  2. Parking lot accident with both cars backing out of spots?  I can pretty much guarantee insurance will call it 50-50.

  3. Did you call the police? They usually determine who is at fault. If you go through the insurance company and you should and it will go on your record if you are at fault.

  4. Sounds like you both are equally negligent.  It is likely this will be a 50/50 accident.  File a claim under your mother's collision coverage.  They will apply the deductible up front then subrogate for 50% against the other party.   I assume that your state follows the modified comparative negligence rules.
