Me and my Fiancee need to find out which way is the best to get married in America?!?

He is coming to America to go to college but we want to get married either before or after his course. Would it be better to do the fiancee visa first, get married then do the course, or do the course then do the fiancee visa and get married?

  1. Personally, let him come on a student visa. You can still be togethere while he is studying. That way you both can get to know each other better during that time. If both still feel the same way after he is done college, then go for it.**


  2. yak is right.  but the answer i provided the other day still applies. but on the positive side he would still be granted his status.  it all has to do with how you answer the questions at the interview.

  3. He doesn't need a Fiance Visa.  If he's here, legally, as a student you can get married before his I-94 expires.  After you are married:

    You file I-130, I-864 and G-325A

    He files I-485, I-131, I-765 and G-325A.

    You file everything at the same time, in the same envelope.

    In about 90 days, or less, he'll get his work permit.

    In about 6 months he'll have his immigration interview.

    In about a year he'll get his green card in the mail.

    The total cost to file all the forms is going to be $1,365.

    You do NOT need a lawyer.

  4. well to be honest, in my opinion i think your fiancee should do the course first then do the fiancee visa then get married because if the both of you (in my opinion) get married before the course it would be kinda difficult since your fiancee has to support your life and kids (if you have) and it would be better if he finishes first since he would be able to support you more without any hard difficulties at all like finishing courses and stuff like that.

In all honesty if he marries after the course it maybe suspicious due to the fact the main purpose for his entry is marriage and by entering on a student visa then marrying might make his application for a marriage visa more difficult.  Granted he can marry while he is here but his status as a student does not allow him to remain permanently in the US. Therefore he will have to apply for a change in status which may require him to return to his country while the application is being processed.

    On the other hand if he applies for the marriage visa then he may not be allowed to enter until his application is approved which may mean he cannot start his class when he wants.

    In my honest opinion the best course for the both of you is applying for the marriage visa and then after you marry start the course. In conclusion there is one rule to follow when dealing with immigration matters be 100% ccompliant and 100% honest otherwise you may find yourself in it deep.
