Me and my fiancee are getting married on a K-1 fiancee visa this August and after about 4 months of ...(cont)?

being married she wants to fly back to the Czech Republic (her home country) for about 6 months before coming back. What do I need to do or get to make this happen? Thanks for your answers. :D

  1. After you get married she needs to file I-485, I-131 and I-765.  The I-131 is a permit that will allow her to travel outside the USA while the I-485 is being processed.

    She MUST file the I-131 BEFORE leaving the USA, preferably 90 days BEFORE her departure.


  2. The first answer is correct in what paperwork to file. Basically she needs to get prior approval to leave. Be aware that if you applied for a green card when she leaves her paperwork goes to the bottom of the stack. You will be back at the end of the line. Also if she stays out 6 months or more she loses her immigration status. So make sure shes only gone for 5 months or less to be safe.
