Question:

Me and my friend (both 21) were drinking a couple beers, and our 2 20 year old (within about 5 months of 21)?

friends came in and decided to grab a beer each. Well the cops showed up and gave them both breathalizers and gave them minors, they blew a .01 and a .02. The cops didn't arrest us but said if county wants to press charges we are looking at gross misdemeanors and jail time. I have never in my life been in trouble before,none of us have and all of us completely cooperated with the cops, but I am kind of freaking out, because I don't know if county will press charges or what is going to happen. Can someone tell me what I might be in for? Anyone experience anything similar or are familiar with law enforcement? I just want to know if I should plan on jail or what.

I'm a little unclear as to what they are charging you with .  I'm going to assume it was letting minors drink?  While you have a moral responsibility to say no, legally, the server or bartender that served them would be fined and the establishment can be fined and have their license suspended.

    HOWEVER, if they were drinking in your home, car, etc, and YOU were the one who served them or allowed them to drink in your home..  Then, yes, they can charge you with contributing to a minor.

  3. you can get a .01 and .02 from gum ...just dont admitt to giving minors beer ...have them say they supplied it !!!!

  4. I wouldn't worry about it.  If they were going to do anything they would have done it then.  Jail time - no way.

They could charge you with providing alcohol to underage, but it there was no arrest at the time then it's unlikely that there will be much follow-up.  Just be really careful not to get caught in this situation again.  In many places they are really cracking down on underage drinking.  Even if there is follow-up and charges are brought, it isn't likely that you would serve jail time, probably a fine and maybe probation.

Your two friends are looking at misdemeanors, which means they could end up getting a fine and/or community service.  You and your friend...if the investigators decide to charge you, are looking at a gross misdemeanor "Providing alcohol for minors".  Technically that means up to a $3,000 fine and between 90 and 364 days in the workhouse.  I highly doubt that would happen, probably the same as the two with the minors, a fine and community service with probation.  That is if they even charge it.  Tough to prove that you gave it to them.

  9. i got a misdemeanor when i was 20 (which is ridiculous) for supplying alcohol to minors. i went to court and all i had was a hefty fine. no jail time at all.

    if your county takes the time to prosecute you for such a little thing they must have too much time on their hands.

  11. Most cops are wimps and the tend to harass kids and homeless people because there vulnerable. I'm an engineer in Hollywood CA and cuz I have long hair and am 38 yr old they don't mess with me cuz they know I will kill them in court

  12. If you weren't under the influence, then you won't get in trouble. It would be your 20 year old friends that would. Just don't get drunk or anything. Getting into that stuff is bad voodoo. It's unlikely the county will press charges though.

  13. You might be charged with serving alchol to a minor or perchasing alchol for a minor. But in your defence just tell the county that they are 20 and they kno right from wrong they are your friends and all but they should be more responsible. Get a lawyer to help you out.

    First of all, why would the cops come? They don't just randomly show up at peoples' houses and breathalize them.

    Second, you should have known the cops were coming...seriously, haven't you ever heard the phrase "Hide the shytt!" ???

  16. If you were not arrested take the cops advice as a warning.

    I very much doubt you will go to jail if your even charged.

    You could most likely face fine and probation.

    I'm not making light of what happened just letting you know that if you were charged with something as providing alcohol to a minor... It looks pretty bad on paper but you know your friends were 5 months away from the legal drinking age.

    It looks worse than it really is.

  18. Honestly, its very doubtful that they will enjail you since you arent the owner of the bar/club/ect.

    This is the case in my state, california, but i dont think other states have much stricter laws.

    dont worry too much because theoretically they cant do much to you.

  20. They almost never put people in jail for underage drinking.  They'll just fine you heavily and call it a day.

  21. There's a couple of things to consider here:

    1.)  How big is the county you live in?  The reason I ask is the bigger the county, the less chance it's ever going to show up on the court dockets.  The county is going to handle the most serious of offenses first, especially with it being a case like this.  I had a friend in a similar situation but he was never called BUT Hinds county has a high crime rate-in other words, they're more worried about catching the murderers, rapists, drug dealers than worrying about a couple of kids drinking, especially when their BAC was that low.

    2.)  This is your first offense right?  When I was 18, I caught a felony charge (stupid mistake), but the judge offered me a deal to keep it off my record.  Basically attending probation meetings (drug tests/paying about 60 a month) and community service.  First offense, you're more than likely going to get a slap on the wrist-it MIGHT go on your record, but if you keep yourself clean after that-say, get in school, something of that nature-you get the whole deal expunged off your record.  EVERYTHING-probation time, record, whatever-would be wiped clean.

    Good luck with everything-I'd say the best thing is to not worry about it too much (you could end up worrying up to two years-that's how long most states have to prosecute you).

  22. nothing to lose any sleep over. County wouldn't waste their time with that. And forget about jailtime. some cops just like to play the holier than thou part in some play they have going in their heads
