Me and my husband both are Green Card holders and we would like to adopt a child from India.?

Can anybody please give me some information about adoption from India. Is there any agencies in US where we can adopt indian child.

Response would be highly appreciated.

  2. I'm sorry, but I think this may be tricky. The issue is your immigration status. According to the US Citizenship and Immigration Service, the first thing you have to do on your application to adopt internationally (the I-600A) is prove that at least one of you is a US citizen. Here's the paragraph:

    "Proof of the prospective petitioner’s U.S. citizenship, and

    if the petitioner is married and residing in the United

    States, proof of the spouse’s U.S. citizenship or lawful

    immigration status."

    By my reading of the law, the only way a green card holder can bring an adopted child to live in the USA, is if they have been living with the child as their guardian for at least 2 years outside of the US.

    Here's the relevant section with the part I'm talking about starred:

    "If you are a lawful permanent resident and the adoptive parent of the child or unmarried son or daughter, you must file the following with the U.S. Citizenship and Immigration Services:

        * Form I-130, Petition for Alien Relative

        * A copy of your alien registration receipt card

        * A copy of the child’s birth certificate showing the child’s name

        * A certified copy of the adoption decree (The adoption must have taken place before the child reached the age of 16. One exception: if you adopted the child’s sibling who had not yet reached age 16, the older sibling must have been adopted before reaching the age of 18.)

        * The legal custody decree if you obtained custody of the child before adoption

    * A statement showing the dates and places your child has lived with you, and proof that your child has lived with you and has been in your legal custody for at least two years

    So if one or both of you is close to being naturalized, then after that it would be possible.

    The only other issue I am aware of is that many agencies, and possibly the Indian government, prefer that at least one of the adoptive parents be of Indian heritage. I'm guessing that you are, but if neither of you is, then that might be an issue.

    The first answer has a lot of good links for adoption from India, so I won't add more of those.

    I would have recommended our agency, as they had a program in India for adoptive parents of Indian heritage, but they decided to retire rather than go through Hague accreditation.
