Question:

Medical ins says they will not pay any because auto insurance has paid.?

I explained that was my supplemental med pay that paid the bill. Will medical insurance reimburse me what the auto ins or supplemental med pay paid. If I didnt pay for the supplemental policy the medical would be liable. I was told auto insurance is liable. If medical paid they would make auto pay them back. Is this correct or do they just not want to pay.

  1. This is called the law of subrogation. One company will pay. If one company pays you as well as the second company, then you have to pay it back. But in the case of a disability insurance, you're talking a different story here. If you have a disability clause, it doesn't matter how many companies are involved. Each company that you have a policy with, that contains a disability clause must pay you.


  2. Yeah that's not uncommon.  Its somewhere in the terms or fine print that if another insurance or company pays then they dont have to pay.

The answer will depend on what state you are in.  For example if you lived in Maryland, you are allowed to use your Personal Injury Protection (this is an optional coverage on your automobile insurance policy) to cover your medical bills and lost wages up to the policy limit and also collect from the other party and any other insurance that you have.  Basically Maryland allows you to "double dip".  Not all states allow this.  I would suggest that you read your policy and that you consult an attorney for further assistance.
