Mileage vs. Gas tax write offs....?

I work for someone of whom I drive her personal vehicle, but I pay for the gas. Can I save the gas receipts to write off at the end of the year and she gets to write off the mileage?

  1. No, sorry - she should reimburse you for the gas you put in her car.  It's likely not all used for business miles.


  2. She can't write off the mileage if she isn't paying for the gas.

    You could write off the business portion of the gas.  It is a miscl. itemized deduction, which means it is reduced by 2% of your adjusted gross income.  And even then, it doesn't come into play unless your itemized deductions exceed your standard deduction.  

    To do this, you would have to keep a mileage log detailing your commuting, personal, and business miles.  That information becomes your support for figuring out how much you spent on gas for business use.

    If she writes off the mileage, and you write off the gas, then yo have done what is called "double dipping."

    I agree with Judy, she should reimburse your for at least the business portion of the gas.  Then the tax deduction is her responsibility.
