Question:

Military divorce question or divorce in general?

I am currently going through a divorce my husband is the one that wants the divorce I told him that we could get a uncontested divorce if we could both reason with each other instead of him trying to reason with me he took it upon himself and went to an attorney and had the attorney to write up the paper work based up on how he wanted things to be having his attorney believe that we were both in agreeance to that so now he is mad because i will not sign the papers now we are a military family who lives on a military installation my husband will not help me put food in the house he will not help me with any of myself and my daughters basic needs he does not want to help take care of our daughter at all i went to his chain of command to see if they could help me all they stated was that they can't make him be a man and that the situation is very sad and that because we live on post they can not make him do anything for me until i move off post but given my financial situation I dont have the money to move nor to get a place and I only feel that it should be all up to him to make sure that his daughter and I have somewhere to live considering the fact that he wants the divorce he has even stated that he is going to take his name off of the lease for housing on post to get me and his child put out he knows that i dont have anywhere else to go no body i can live with or anything granted I know that i will be entitled to the BAH once I move out of the apt on post but if I dont have the funds to move I dont know what to do especially since he will not help me anyone have any suggestions i feel as though he is really trying to get over on me and my baby i work a job through a temp agency but temp jobs u never know how long they are going to last given the area where we are at the job market is very scarce he does not want to help me to pay someone to keep the baby while i try to work but yet he does not want to take care of her either since my schedule is from 4pm to 12:30am I really dont know what else to do can someone please offer me any good advice im not sure how divorces work when going to court but if i show the judge all of the receipts that i have showing what i have been doing to take care of my baby will the judge make a ruling in my favor if i can try to sue him for not contributing equally to help take care of his child does anyone know? please this is a very serious situation no negative responses please.

  1. You could refuse signing the divorce petition, which is equivalent to filing a contested divorce. This would at least level the playing field and give you a chance to defend yourself. However, before the proceeding takes place, I suggest you look for divorce laws in your state regarding military divorce and grounds for divorce.
