Okay So I tapped a lady's bumper, we filed no police report because there was no apparent damage. We talked worked it out and everything. She wasnt hurt and neither was. She did not ask for my ins information. We left and that was it. Something didnt seem right so when i got home I immediatley took pics of my car. I have not one scratch from the incident. A few hours later her insurance called me claiming that she had been injured and it was damage done to her car. How far can she get with this case? Wont my insurance question her about if she was injured why wasnt the ambulance called or at least a police report if her car was damaged. I kno i didnt take pics of her car in which I regret but I did of mine so these damages she is claiming certaintly didnt come from my car. I cant stop thinking about this **** its driving me crazy she also has gotten a lawyer Im starting to get really bad headaches, Im on my mom's insurance and I dont want it to go up but Its really nothin I can do...

  1. your insurance company runs the risk of paying for the damages since the accident was your fault. Your insurance agency will not isssue any checks until an adjuster determines what damage was caused by the accident.  So, if the claimant is attempting fraud, the adjuster will be the first person to move your insurance company in that direction.  Keep in mind, the person calling you may have simply been told by the policy holder that there was a small scratch on the bumper and that she feels sore.   Her agent then, depending on the state, may have been required to classify it as an injury (even though nothing will come of it).  By now I'm sure you contacted her agent and hopefully everything is on the up and up.  Hope it works out.

  2. You dont' always know you're injured right away in a car accident.  It can take 2 days before back injuries appear.

I thought I was OK after mine (of course I wasn't) - and I told them so - and I worked my day at work (I'm a substitute so working included walking, sitting & standing)  I did have a back injury -  So yes she could have been injured.

I am sorry this happened to you!

  3. At this point all you can do is file the claim with your insurance company and give them a statement telling them what happened. You can forward your vehicle photos to your insurance company. Let them handle it from there.  Don't worry... good luck!

  4. Your insurance company should handle it.  They should do a 'low impact' investigation.  It looks like your lady is trying to win what we claims adjsuters call the 'Auto Lotto'.  You really have nothing to worry about.  Oh and her gettimg a lawyer? All that does is reduce what she would have gotten anyway by at least 33% (Lawyer fee to do nothing but file paperwork), so at least you can smile about that!
