Minor child support law

I live in Cincinnati Ohio. My wife and I recently took in her 16 yr old pregnant cousin. We are in the process of obtaining custody of her. The father of her child lives in Florence Kentucky. I was wondering if there was a possibility of her seeking child support from him? What do child support laws state about minors seeking support from other minors? I know it's a messed up situation but there is no alternative so please don't judge the situation, I am simply looking for information if it's out there.

  1. You'd be better off having a short consultation with a lawyer as it's complicated and involves 2 states on top of it all.  Seems that in a lot of states, if there is a child support order for the dad, his parents will have to pay it until he's 18 or becomes emancipated.  

    Looks like guardians of your cousin have to bring the action for support because the mom is a minor and the guardians are responsible for the baby because the mom is a minor.

    I'd suggest speaking with an attorney before proceeding with custody of your cousin - it may be better if she became an emancipated minor.


  2. I think it depends on the age of the father of the child.  I certainly would try though.  Sounds like she will be needing diapers real soon.

  3. I doubt she will be able to get child support until she and he are 18.

    She can get some government assistance.

    Be careful not to let your cousins issues ruin your marriage.  There will be a LOT more stress in your household.

  4. There may be a way for her to collect child support depending on the laws in your state and Kentucky.  Personally, I believe if you are old enough to make a child, you are old enough to pay for that child.
