If a minor purchases a car by misrepresenting his/her age and fails to make payments and the car seller sues what will do the court in MOST states.?

  1. fraud is a felony thats if they get you involved in the criminal side just looks like they are going after the money


  2. a minor purchases a car by falsifying his or her age?  who ever handled this sale should eat it.  how stupid could the seller be not to do a complete background check of the purchaser.  

  3. The buyer has to have either the full amount of the car to buy OR must apply for an auto loan.  On the application, the buyer must include their social security number and that gives the dealership the buyers real name, address, age, credit score, etc.  What I would think happens in most every state if anyone defaults on a car loan, the bank repose's the car (because the bank owns the car, not the dealership) the bank will come after the signer of the loan.

  4. Most likely, the minor will be forced to return the car and pay damages because he lied in the first place and the seller acted in good faith. Lying about your age does not give you a get out of jail free card to just get out of the contract whenever you want.  

  5. Nothing, a minor cannot enter into a contract.  Now if he made payments and honored the contract, he would be stuck with it under it's terms.

  6. They will repossess the car and kill your credit score. That's about all they can really do.

  7. You would first have to prove that the purchaser did misrepresenting them self.  If you do take legal action it will probably fall on the minors guardians financially.
