Minors smoking legality question

if a minor trys to by cigarettes at a gas station and they ask for a card, and then they dont have one, and leave can they get into trouble? my younger sister tried to buy cigarettes, and is panicked theyre going to get her in trouble... i didnt think they would but i just wanted to chek

No, she won't be in trouble but the gas station won't sell cigarettes to her anymore. They kinda remember things like this!

Dont' start smoking. No you can't get in trouble. If you use a fake id you can but not for just trying to buy them. Up until recently my state had a wierd law where minors could't buy smokes but there was no law against smoking so if you cant get them your okay. They finally passed a law banning smoking for minors though.

In most states it is against the law for a minor child under the age of 18 to possess tobacco products.  Since your sister didn't succeed in her purchase, she did not possess tobacco products.  She should also realize that had the clerk not checked her ID and refused to sell to her without an ID or underage she could have gotten him a pretty heavy fine for selling tobacco to a minor had the transaction been completed and caught by the police.  She is not only risking legal problems for her by trying to purchase tobacco underage, she is risking getting others into trouble ... not very nice.
