  1. Actually the Miranda Rights is the act of the police actually reading you your rights.  The Supreme Court, with the ruling of Miranda vs. Arizona, required that police tell you your Constitutional right before you are questioned.  You have the right to remain silent, the right to an attorney, etc.

This has caused many criminals to go free because of technicalities.  As an American you are required to know the laws of this country, you should also be required to know your rights.  Time for the Miranda Rights (the ruling that the police have to read them to you) to go away.

  2. you probably wouldn't mind not having miranda rights.... until you got arrested.

  3. The "Miranda rights" are merely a reflection of our protections outlined in the Bill of Rights. It is the civic responsibility of every American citizen to know these rights before they are out of high school. For possibly dangerous felons to go free because a cop forgot to remind someone of those rights they should already know is patently stupid, especially when such a high percentage of them have had those rights read to them more than once in the past. Police officers have a lot more important things to do than pull out a card and read it in English and Spanish to everyone they have to slap cuffs on. I know I'll get a lot of flack for this answer, but I don't give a flyin' flip.

  4. We need them for the Pro's and Cons!

  5. Miranda Rights are....you have the right to remain silent, anything you do or say can be used against you....etc.  Pros....if they don't tell you at the time you get arrested and when taken into questioning....then they violate your rights and you can get it dismissed.  Cons.....and for the cons.....you do or say something ....it will be used against you.

  6. We need them for sure.

There are times when after something happens that requires police action that people are actually trying to explain themselves and instead make matters worse.

If you have to deal with this you will soon see that once they charge you the best course of action is SET DOWN and SHUT UP after they book you make bail and call a LAWYER.

Once Barney slaps the old bracelets on you, you are going for a ride and that is that.

  7. We can do without them. We can also do without a justice system altogether and send out enforcers to execute anyone who causes trouble on the spot.

However, if you value a fair system of justice that is fairly accurate in determining guit and handing out appropiate justice, then having Miranda rights is a tool that helps a community accomplish that. Why should an arrested citizen not know the rights he has at his disposal? h**l, the military had Miranda rights long before every other citizen did, and the UMCJ is known for being rather draconic in possible punishments. Why should the military be afforded rights that every other citizens doesn't possess?
