Question:

Missing earned paycheck?

I have been working for the same company for the past 10 years. We get paid bi-weekly. I worked the past two weeks. At the end of these two weeks I expect my pay check. The company that I work for is having a cash flow problem and I did not receive my paycheck as scheduled. What is my recourse? I need my money!

  1. What did they say?  Something like "you'll have it Monday of next week"?  If so, then if you get it then, there's not much to do but wait.  If it goes on for awhile, you can report them to your state department of labor, but if they just really don't have the money, that won't get you your check.

If they go bankrupt, the employees will have a high level claim to any money that's left, but if there isn't any, there isn't any, and it's possible that you won't get it, or will only get a part of it.  And that could take a long time.

I'd be looking for another job, especially if I didn't see my paycheck VERY quickly.

    Good luck.
