Is it true that in the state of MS you have to have complete control over your car at ALL times? so that would mean if you were to rear end someone it would automatically be there fault?

  1. Rear-ending someone will always be your fault even if they pull out in front of you because at that time you will need to be in complete control of the vehicle.

  2. If you rear end somebody, it is you who has no control over the car, not the person you hit.  It cannot be the fault of the person you hit unless he/she popped it into reverse and floored it, backing into you so fast you had no chance to avoid the collision.  That would also take witnesses, or video to prove.
