Modify child visitation order in california?

i have a restraining order against my daughters father. He consistantly violates this order. He has threatened to kill me on more then 3 occassions. He has called and contuines to harrass me. We came to an agreement on visitation last week. I've tried twice to contact him to no avail. He shuts the lines of communication down. He hangs up on me. Even goes so far as to threaten to take my daughter to Mexico, when he sees her. Of course, in court he will deny this. What do I need to say to modify this order before visitation starts. To get him court monitored visitation. My daughter will be 2 next month and they have absolutely no relationship at all.

  1. tap your phone. i am not kidding. you can get something that will record phone conversations and you can use this when you talk to him and use this in court. also write EVERYTHING down, everything he says does, doesn't do whatever it is that relates to the child and visitation and the threats against you, i would think that if you have a restraining order out against him that should be enough for the courts to take another look at him and his parenting skills. but you know courts these days they really don't give a d**n. have someone there when you meet him as a witness to his behavior or carry a small tape recorder with you and record your conversations, you need proof. real proof.


  2. You need to get in touch with someone that has the knowledge and expertise to sort this out.  Maybe a family court lawyer or family therapist?  I would do everything I could NOT to let the father have the child unsupervised until this situation is resolved.
