how would you handle this situation

a married woman has a baby with another man

later finds outs he is not only mentally unstable but an unconvicted pedophille

her husbands name is on birth certificate, and they have been raising baby in healthy home

the guy 2 yrs later now comes out of the woodwork threatening to have the mother served with a paternity test order

my question is will a court even grant this to some crazy man claiming he has a baby with a married woman?

and #2 if she does get served, should she leave the state before the test gets taken?

she doesnt want child support from this man,she wants only to protect her child from this deeply disturbed man

unfortunatly, courts wont protect your child from an abuser until the act has been committed and proved

how many of YOU would sit around waiting for your child to be molested before protecting them from that BEFORE it happens

obviously, there is more, but cant fit it here

wouldnt you avoid the test,by leaving

  1. if the other guy is a convicted pedophile, i dont think that he could raise a child.  period. should she get served with such papers, then bring up the fact that he is a convicted kiddy-toucher.  no judge in their right mind would allow another child to possilbly be put in that position

  2. In many states, the husband is the legal father no matter what anyone else says. The "real" father has absolutely no legal right what so ever to demand a paternity test. I'd tell the woman to contact a lawyer and find out exactly what this man has a right to do under the law in her state.

  3. Is this for real? If so, thats a pretty bad situation. How does she know the father is a pedophile? Are there victims, witnesses? I'd pull together whatever proof I could to show that this guy was a sicko.

And leaving is only a temporary situation...eventually the police would find you. Its better to have this person convicted and get him off the street before he harms any other children!!

  4. does this other man have any prof what so ever as to that being his child?  Couldn't she just say that he is some stalker ex boyfriend or something and have the court drop it?  Especially since her husband is on the birth certificate?

  5. get some help from the law

  6. If my husband knew and was ok with raising this baby, I would skip town ASAP and change everyones names and go somewhere this man could never find you guys...

  7. I would leave the country in a heartbeat.

  8. I would do whatever it took to protect my child. However, even if the paternity test proved he is the father, what court would give him rights? I wouldn't think he would get very far and he'd have to pay a ton of money for a lawyer and other fees. Does he even have the money for that? I would weigh all of the options and do whatever I thought best. Even moving out of the state isn't going to protect you- he will just find you again, right?

  9. This is a loaded sitution.  First of all, does your current husband know that this child is NOT his?  And if not, WHY?  This will be your first hurdle, but aside from that you are going to have to do EVERYTHING you can to protect this child.  This child should not be subjected to the chance of being molested or worst by this man.  I am not quite sure running is the answer, I'm more inclined to suggest get a Great Lawyer and fight!!!  But, be advised a good run beats a bad fight anyday!!  Be Proactive....Fight....What ever he could use against you...get it out in the open and Handle your business!!
