If I was a victim of a mortgage scam, will I face charges and/or jail time? If I didn’t know what was going on at the time, wasn't told the truth and was completely misled, yet I signed the documents because I was told to, can I still face charges??

  1. If you committed fraud then of course.    You need to be more clear about what you signed.   If you know what you were signing was not true and correct then you would be guilty of fraud against the bank, you are not the victim, but the perpetrator and it is a felony offense.

Someone telling you to sign is not a defense.    If they told you to sign or they would kill you or your children, and you had reason to believe they would carry out the threat you will be OK.....otherwise you will be facing felony charges if the bank catchs wind of YOUR scam.

  2. Unless you can prove that someone put a gun to your head and forced you to sign the docs or you were heavily medicated...then I'm afraid you are culpable.

  3. You are technically part of the scam, but if you contact the prosecutor and offer to testify ... about how they lied to you too ... you will probably come out OK.

  4. It's possible - if you think your in trouble - get a lawyer

  5. Only and attorney can give legal advice and they need to know the specifics.

  6. I guess this falls under the " if you were told to jump off  a cliff " category.
