Mortgage forbearance still reported 120 Days Late on credit report?

I was granted a mortgage forbearance last October for an unspecified period of time while I prepare a lawsuit against my realtor for selling me a condo that had known humidity/mold problems. Since then I have not been required to make any payments at all.

I recently discovered that due to a mess-up somewhere I was being reported as late on my mortgage payments since last November. After a number of calls to Fifth Third they blamed Fannie Mae and promised to correct the problem.

My free credit reports now show all mortgage payments as having been made ON TIME but also shows the account as 120+ days late, taking my FICO score into the average zone. The credit reports also have the statement "Arrangement made with credit grantor to make partial payments, 120 Days past due".

Shouldn't the credit report show that my mortgage is under a forbearance and that I am not actually "late" on any payments? How do I fix this?

  1. You used to have the right to demand that the bureau include a "consumer statement".  This won't change your score but will be seen by anyone reading the actual report.


  2. You may have to continue to make calls so they can correct the errors in your credit report. Since you don't have anything in writting you don't have much ground to stand on. Just keep trying to call them and explain that your credit report isn't fixed yet. This is the best advice I can offer you. Sorry!
