Question:

Mother won't sign stepson to go to Canada?

Stepson's mom is angry that my husband went to court to get more visitation. We have family in Canada and go quite often. It has never been a problem having her sign and let us take him there for the weekend until now. We are planning to go to Canada for one of our week visitations next month and stepson's mom won't sign a form allowing him to cross the border because we ended up taking her to court (and winning) more visitation. Is there anything we can do about this, or do we just suck it up and stay in town for the week?

  1. Really not much you can do about it.  If she does not give you permission to take the child into Canada then you may be running the risk of her saying that you are "abducting the child".  Not really worth the hassel.

Only option is to go to court again and get it put in the court papers that when your husband has visitation that he has the right to take the child with him into Canada and that it is not considered a flight risk to travel to Canada to visit your family.

  2. Why not leave stepson with his mother and go to Canada without him?  If he whines and complains to her for the week, so much the better.  Crummy thing to do to the kid though.

  3. How much more do you want to upset her?  You could go to court and fight over it or just stay in the US.  Probably will not be able to get anything done in time for your next trip.  Doesn't seem worth it to me but it is your call.
