Motorcycel wreck it was not my falt. now what?

had a motorcycle accident. and im wondering what if there going to call it totaled. the frame is ok and it runs still. but the front is broke all the plastic and the forks are bent. and the tail lights are broke. also the foot peg is broke and the rear seat with the compartment is broken. oh and the gas tank is bent from my p***s hitting it.

its a 2005 yamaha r6.

its gonna be called totaled right?

also i had to go to the hospital for x-rays and luckily i didnt break anything but i did hit my p***s pretty hard. how much can i expect from their insurance company if it was her falt.? should i go after them with a lawyer to get more money?

  2. first off, DO NOT give her insurance company a recorded statement...they'll be calling you pronto.

    Tell them there isn't going to be a recorded statement and then they will likely ask you if you've retained an attorney... Tell them that you would hope that you could resolve this matter without an attorney...

    They should be pleased to hear that... Don't accept any offer to settle at this point...

    Settlement should be about 6 months from now because I'm sure you have more medical problems that your aware of...

    Go see a chiropractor, her bodily injury liability or your PIP should authorize treatment and pay the doctor...

    They should also, promptly pay your vehicle damages to you... This is not a settlement and they want to keep you happy, so they will likely pay you pronto whatever they deem your damages to your bike is worth...

    I'm sure you could use some Chiropractic care, and after you go through whatever treatment he prescribes to you....and after you feel great, usually in about 3 months or so, then when the final doctor bill is rendered to the insurance company for final payment, they will call you and start the settlement process...They will lowball you to test the waters, decline and they will likely increase it by 500/1000 immediately... decline that also and tell them you were hoping that you could resolve this without retaining an attorney, but that they are going to have to come up with more than that..... A reasonable settlement amount is approx 2 to 2 1/2 times your total medical bills...

    So take the time to get the treatment you need, don't settle too fast because your hungry for the money, the insurance company is hoping that and who couldn't use a couple grand at any time...

    But hold out and you should bank 5,000 easy...

    When you finally agree to a figure they will mail you the paperwork, you take it to  a notary public and have it notarized with your signature and send it back to them.... a check for what you agreed to should be promptly sent out to you within 10-14 days.... It's easy and I've settled several cases myself and saved thousands in attorney fees.

    My attorney told me he couldn't have done better.
