Question:

Moving while filing for divorce in Missouri?

I'm moving out of my husband's house this weekend and we'll be filing for divorce shortly after. I've looked up the laws and there doesn't seem to be a problem with that, but I currently am living in Missouri and I'll be moving to Illinois. A friend of mine said that when she got divorced, her husband had filed and then moved out of state and because of that, they didn't allow him to go through with the divorce initially. They had to refile. Is this true? Will my moving interfere with filing for divorce, especially since I'm the one filing everything?

  1. It's best to ask your lawyer.  Especially since you are filing.  Usually the rules of the divorce apply to where the person who is filing lives so it may make a difference.  If the case was already filed and in process the rules may be different.  It may not matter.  People move all the time.

  2. Yes, your residence is important where you file.  You need to speak to an attorney asap.  They will give you a free consult.  Check it out.

fyi, i live in st. louis and my ex and i did the divorce ourselves because we agreed upon everything and we found the papers online and everything and did it on the cheap.  Highly recommended if you can both agree.

  3. Perhaps it depends on your state, but unless you have children involved, you are free to move.  If you have children, you are not.
