Question:

Moving with kids after divorce, has anyone gone through this?

My girlfriend and I have been together for a little over five years we plan to marry in the near future (within the next year and a half-ish). Over the course of our dating she attained a BAA in accounting and I have almost completed a BA in art with my license in art education. Her Ex husband has been on the side lines through out the process drunk, unreliable, child support delinquent, and just an all out pain in the a$$. Her children want to have nothing to do with him. They complain that when they are with him they do not get fed, the house is dirty, and he is either angry or passed out drunk. We would have a much more comfortable life with higher salaries and better benefits if we moved out of state. The original court documents outlining the conditions of the divorce restricted her from moving outside of the county. How much of a problem would we have fighting to overturn this stipulation in court? Thank you very much for your time and input

  1. Well first of all, if you move out of state it makes it that much harder for him to do anything. He would have to hire a lawyer which takes a lot of money for an out of state case. The second thing is that if he is not paying child support, even if he does get a lawyer, the lawyer would tell him that he would have to get caught up in child support before he has the right to do anything. So, I think you would be pretty darn safe. He sounds like a loser and I doubt he would do one thing.

  3. sounds like she has a pretty good case before a judge. it would help if you were married.

  4. From what I understand in my state, and all states are different, but the judge does take into consideration the financial end of moving out of state but you need to stay far out of the picture because they will frown on involvement from a lover.  She also needs to state her concerns about the alcohol abuse and all the other mistreatment's of the kids.
