Must a vehicle pass inspection in order to be sold by a private seller in North Carolina?

My brother recently purchased a car in NC without having it checked out by a mechanic beforehand. Two days after purchasing the car it begins having trouble. He then takes it to a mechanic who tells him the car needs a new engine, and the car will need numerous repairs in order to pass state inspections. However, the mechanic told my brother that a car must be able to pass inspection in the state of NC in order to be sold. Does anyone know if this is true, and if so does my brother have any legal recourse?
