My 16 year old daugher was in a car accident. She was visiting her sister and a neighbor friend told her she could drive her car. She was t-boned by a truck and was at fault. We have heard diffrent stories from the owner of the car as to weather there was insurance. We think she let it laps. Who will the owner of the truck go after for damages to her vehicle? My daugher was not on my insurance. We don't let her drive our car.

  1. What would you file against the owner of the vehicle that your daughter was driving?  

    Were the police involved?  Did they verify your daughter was driving an uninsured vehicle?  This are things you can find out yourself.

    The owner of the truck could generally in this order, first go after the vehicle owners policy, then any drivers policy, then any third parties such as guardians or parents if they chose to do so. But that doesn't mean they will.

    Liability tracks as follows

    Primary Financial Liability coverage would come from any existing Auto Liability Insurance policy on the vehicle being driven, so long as permissive use applies.

    Secondary coverage would be provided on any existing Auto liability policy covering the driver even if for another vehicle. It would have followed her to a loaner.

    As far as a possible suit, the driver or the owner of the truck would have a case against either minor child, The driver or the owners child and their parents or legal guardians.

    Additional Details

    All you really can do is wait and see whats going to happen, just because they can don't mean they will. It may not be as bad as all that. If the guy in the truck does not file for injury then it could be a simple property loss valued just on damage or loss of the truck.

    The other insurance company will likely only go to third parties if they think it's cost effective.

    You may could make a case against the vehicle owner for primary liability but since it was another minor who gave the permission i don't know how difficult the case would be. you'd probably have to talk with an attorney about it.

  3. Laws vary from state to state, but 'usually' the insurance covers anyone driving the car with permission.  If they let it lapse, it's going to come back to you since your daughter is under age.  You need to contact your insurance company right away!
