My 2 yr old son was hit by a car at a acura car dealership,

my son and i were looking at cars at a acura dealership as we walked out between 2 cars at the dealership a ford mustang driving way to close to the cars and way too fast going easily 20 mph hit my son , he went flying a couple of feet, and then as he was trying to get up he got hit again as the guy was slamming his breaks, his injuries are the following, no skin on top of foot all the way down to bone it will have to be treated for a yr , he has lost all toe nails, and he has bumps and bruises.i called ambulance and police and we were at hospital all day i have called attorneys but can i sue the guy who hit my child for going so d**n fast? and driving wrekless, he was in his own car, he wasnt employed by acura as far as i know. any one have any advice

over1 0 mph is reckless at a car dealership, essentially a car dealership is a store out side you wouldnt go that fast in walmart. also my son was 2 feet ahead of me, i was there. my son did not dart out in front of this car we barely stepped out from between two cars at a dealership i was looking ahead and next thing i know as we were walking between two cars to go into the dealership a car came around the corner with in seconds, and i had no time to yank my son i just remember making eye contact with the driver and yelling stop stop, i thought my son was going to be dead. when we decided to cross there were no cars, after we stepped out between the cars it was too late and the driver came a around the corner so fast i could not even yank my poor baby out of the way fast enough. what can i do about this? i have got the all the drivers info do i need to file a claim with his insurance, i have no idea what im doing. i havent called any one yet by sons doctor.

  2. Sue him.  He was driving recklessly when he wasnt paying attention and hit somebody, causing physical harm.  Get a lawyer, then paypal me some money.

  3. are you going to keep asking until someone who is NOT educated in insurance gives you an answer you like?

    Look- you were partially responsible here.  If you had control of your son he would not be in the road before you knew traffic was clear.  No ifs ands or butts- your were negligent- no car can go sub-sonic speed faster then the speed of light where you cant see them coming.   As a pedestrian- regardless of the speed of traffic down a road- you must yield to them.  Atleast take responsibility that you are partially at fault here.

    Also- You and have idea how fast the  other person was going.   You dont have a radar that you carry around so you are completely guessing.  Everyone who fails to yield always says "the person was speeding! i couldnt see them!"  Doesnt fail.. every time.

    Now- that being said. you need to file a claim through their carrier.  They will likely find their guy a portion at fault and cover a portion (if not all) of your medical bills.

    The way your throwing around "SUE!" i can tell you dont know how insurance works.  Your not going to go after the guy (hence sueing) your simply filing a claim through his bodily injury coverage on his policy.

  4. First of all. Who the **** lets their 2 yr old walk around on their own in a car dealer? You have got to know that vehicles could be coming in and out of that place at any time.

    I feel sorry for your son for having an incompetent mother.

    Secondly, before you go jumping the gun and sueing people. Why don't you make a police report? and then file a claim with his insurance company.

    If this person doesn't carry enough coverage, then you make an underinsured motorist claim on your own auto policy for your son. That is, if you have insurance and that coverage

  5. You need to file an injury claim w/the insurance company of the guy that hit your son. They will investigate the claim and if they find their driver at fault they would pay reasonable and customary mediacal bills associated w/your sons injury. they would also offer something for your trouble to resolve the claim.  if you choose to accept their off you would have to sign a release and you would be unable to sue the driver.  depending on what state you live in you may want to open a claim with your insurance company too b/c they may have injury coverage for you and your household members - even if you are out of your vehicle. good luck

  6. Hmmm, 20 MPH and he only flew a "couple feet"? I have noticed you keep asking this question. Get an attorney and hope the driver can't prove you were negligent by not having a 2 year old under control.

You shouldn't have left the scene without calling the cops.. if there was a police report and the cops considered him guilty of the accident then he would have been responsible for all of the medical bills..  at this point with all the drivers information you might still be able to file a police report.. maybe the dealership even has a camara that caught the accident.. but in order to be able to do anything about it you need to have reported it..

    I don't know about being able to sue him for more money but he should at least be responsible for the medical bills..
