My 2 yr old son was hit by a car at a acura car dealership, whos fault is this? can i sue for medical cost?

my son and i were looking at cars at a acura dealership as we walked out between 2 cars at the dealership a ford mustang going easily 20 mph hit my son , he went flying a couple of feet, and then as he was trying to get up he got hit again as the guy was slamming his breaks, his injuries are the following, no skin on top of foot all the way down to bone it will have to be treated for a yr , he has lost all toe nails, and he has bumps and bruises.i called ambulance and police and we were at hospital all day i have called attorneys but can i sue the guy who hit my child for going so d**n fast? and driving wrekless, he was in his own car, he wasnt employed by acura as far as i know. any one have any advice

  1. You should contact an accident attorney in your area. Most will give you an initial consultation for free, Then they will tell you that yes either you have a case or no you dont but at least you would know. Did you get the drivers name? Insurance? Accident report from police? Most attorneys will take cases and then only require payment if you are awarded a settlement and then they get a percentage. Before you do any of that though you should make sure your son is ok and take care of any medical conditions he has

    I can't believe he wasn't arrested or cited by the officer. Hitting a child with a car, and also speeding? Right? Isn't that illegal there?

    Car insurance usually covers accidents so his insurance should pay for the medical bills, you should get that information. He could probably be sued in civil court for damages too. Get a good lawyer, a GOOD one.

    I don't think the Acura dealership is responsible since it wasn't their employee, however there may be some responsibility if you could prove there is some sort of negligence on a regular basis (i.e. cars always drive fast in there and it's a real safety issue).

  4. YOU STUPID LADY! Who doesnt hold their kid in a parking lot? It's unfortunate that this happened to your son,but you should have been holding his hand. You cannot control how other drivers drive, but you can control other things---like picking the kid up when walking in parking lot, avoiding walking between cars so drivers can see you. Either way, get an attorney and see if they can help you
