My American born ex-husband moved to Denmark six months ago. He claims he now has a Danish passport. Possible?

He has a Danish born mother who became an American in the early 1990s and she now owns an apartment there.

    This is an act to consolidate the Danish Act no. 252 of 27 May 1950 on the Acquisition of Danish Citizenship, cf. Executive Order no. 155 of 6 April 1978, as amended consequent upon Section 2 of the Danish Act. no. 326 of 4 June 1986 and the Danish Act no. 159 of 18 March 1991.

    1.-

    (1) Danish Citizenship is acquired by virtue of the birth of

    1. a legitimate child whose father or mother is Danish,

    (this is only the beginning it goes on but I think what you want is here.


  2. Very unlikely unless he previously established Danish citizenship.  Most European countries have tightened their  rules for "legacy" citizenship status.  Its become more complicated and difficult to obtain.

  3. Depending on his age, he may have been able to claim Danish citizenship through his mother. If his Danish-born mother acquired US citizenship through marriage then she was not required to renounce Danish citizenship, so she can still pass it to her children; however those children have to apply to retain Danish citizenship past the age of 22.

    Those are general rules, but keep in mind that Danish nationality law is stupidly complex. There are plenty of exceptions, special cases, etc.

    Once citizenship is secured, getting a Danish passport is a simple formality.

    Regardless, I'm eager to call BS on your ex's claim.
