My American wife does not want to help me to get a visa for the USA, could I get it anyway? ?

I am Spanish citizen and I marry her in Spain, after 4 years of marriage she dump me because "she needs to breath". After 6 month she wanted to come back but I said no. This was 3 years ago and though not living together we're still legally married.

Recently I ask her for help to get a immigrant visa to the USA and she deny me her help. Being married to her does it give me any rights to get that visa without her help? Is there anything I can do to get that visa without her assistance?

NO she is not obligated to help you. And being married to her does NOT give you any right to emigrate to USA if she chooses to NOT help you. Better divorce her and find someone else.

you got married in spain, did you get your document done in the US too?

if you didnt .... then you can not depend only on your document from spain!

but you still can find some other way to get the visa to usa.

No I don't think there's anything you can do. The way it works is she has to petition you also they have implemented new security measures now since so many people are abusing this system and send agents to go check up on you guys every now and then to see if your actually married.

U cant. she has too. Self petition was the other option of people who are married but cant get it due to the fact that the husband or wife dont wanna file for them, but to be eligible for that.

you must be an spouse who is abuse.

and some where the person has already have a conditional resident card which is valid for 2 years. if they are married for atleast 2 years then they can also file on their own for permanent resident card. so far you cant. talk to her. thats the best way. coz being married to her should only take atleast 6 months to a year. AMERICAN CITIZEN WHO PETITION THEIR RELATIVE SUCH AS WIFE AND KIDS FROM ANOTHER COUNTRY DONT WAIT IN LINE. (pssstt since u are married to her YOU HAVE A VISA NUMBER FOR YOU ALREADY, just needed her to file for u. GOOD LUCK!
