My Car was hit in my parking space at home while i was out of town. My car had white scraches all over the front and a car that parks in the same area had black marks all over their bumber (my car is black) when asked if they hit my vechicle they denied it. Is there anything i can do? oh forgot to mention this person hit my vechicle once before just not in the same spot. i have their insurance info can i file a claim using that info?

  1. What happened before is no proof of what happened this time.  I would call the police and show them the marks on the two cars.  You will almost certainly have to pay for your own repairs though unless you can come up with a witness who saw this happen

  3. You need to file a police report, and file an insurance claim with YOUR policy, and let the police and your insurance company handle it.

  4. file a report with local police + provide them with the other car's lisence plate number + let them decide if they hit your car. After thats done let your insurance company know. They'll chase them down according to the conclusion of the police. Your insurance will not go up, since it wasn't your fault. it comes under the comprehensive portion of your policy.

    Heres what happened and how to win -

    Take pics of both cars that show paint transfer. I would imagine the other owner is going to clean your paint off soon...go NOW. Get a police report that describe how the damage is at the same level and that the cars are parked next to each other often. Go get three estimates to repair. Go to small claims. Collect money.
