My Companies name is being ripped off, what can I do?

I own Xtreme Power Computers.com. I was searching the web and I noticed that someone, in aother state, started a company named "Extreme Power Computers.com" after I purchased my DBA, TAX ID and a Website. Is there anything I can do to keep them from using my companies name? Are they doing anything illegal?

  2. Your name is only good within the area you registered it > either the county or the state.  Unless you have a Federal Copyright.

    If so, then who was first to register?  If you, then you can have an attorney issue a cease & desist order.  If the other guy, you're out of luck

  3. The last answer was completely correct. You may want to file a federal trademark (although they could oppose it,) Definitely file a entity with your ate.(why would you use a dba, instead of a corp otr LLC?) Any way check to see if there is a trademark filed by them. If they have one you may be the one getting a cease and desist. You may also get one anyway if they have been around longer or are better known. ( Never operate as a dba, now if they come after you it is you they are coming after instead of your corporation. To answer the other question, they are probably not doing anything illegal, why would it be illegal? They are not violating your dba, which is only good in your county, someone else in your state in another county may use it too.  Go to   www.about-small-business.com   , it has some easy straight forward info, read the business entity and trademark sections. Dont want to be the be the of bad news if you push the issue in the wrong way, they may make you change your name.
