My Homeowners Association (HOA) is switching from a property management company to nominate residents within the neighborhood to run it. The residents (besides myself) already decided who they want for President, Treasurer, etc. The "President" has been writing up his own rules that he would like in place. These rules are very unjust and I would not like to see these rules take place because they are specifically written against anything I do in my unit/townhome. What happens if I do not agree with these bylaws and do not sign an agreement to accept the new bylaws?

  1. If the bylaws are passed, it does not matter whether you accept them or agree to them, you are obligated to follow them. Failure to do so can lead to fines from the HOA.

    The bylaws go into effect through a majority rule. If the majority votes them in, you have no choice but to follow them.


  2. Read your bylaws to discover HOW to change the bylaws. I bet there is some voting involved!

    Anytime an organization like this creates rules that target one member or one small group, you can challenge them successfully. Rules created must govern ALL members of the HOA.

    Now, the HOA president has a limited term, no? AND if rules are unjust, you have two legs and a mouth--why not go out and petition your neighbors to support your cause?
