My Indian fiancee has been sacked from her job and must leave her employer in two months' time. We were planning to get married next year, but now we don't think we can get a certificate of approval even to marry here (she must have 3 months left on the visa) - and she's finding it hard to get a job. Anyone got any experience in this sort of thing? Does she have to leave the UK immediately after her last day at work? Can she transfer to a fiancee visa or a marriage visa while still in the UK?

  5. If she only has a work visa it may be very difficult to get it changed to an other type without leaving and applying for re-entry on the terms she now wishes to live in this country.

    Even if she gets another job and you get married there are procedures to follow.

    Everyones' circumstances are different.

    First thing is when does her visa expire?

    How long have you been engaged?

    Do you have anyone who is a professional (Doctor, Solicitor local Councillor) who can sign a document declaring they have known you for more than 5 years (officially its still two I think but longer standings can help)

    Do you have an independent means of supporting yourself and your fiance outside of state of benefits?

    There are many other questions but start with those.

  6. this is a difficult one which only you can decide. if she is here on a work visa and is not working then she could be removed at any time.

    you could apply for a fiance visa, that would give you six months.

    A marriage visa is a bit more complicated. first you have to ask the home office for permission to marry here in the UK. You will have to pay them well over £100 for the privilege and then they could turn you down. your best bet would be to marry in India and apply form there. It could take anywhere from 3 months onwards.

  7. She will have to go and change her visa because if she isnt working then she will be here illegally here on a work visa. She may be granted another visa or she may not but it is best to go and be honest with them.
