Question:

My SUV was hit by a golf ball while driving home. The road passes right next to a driving range. who pays?

the manager told my girlfriend they weren't liable. I've heard that the golf course was liable. Is it the golfer or is it theirs? thanks ahead of time.

  1. Im not an expert on law but i think the driving range would be liable for placing it in a terrible place.Try posting in the Law section if there is one


  2. Go to your insurance company because nobody is liable. Because get this if a person hits someone with a golf ball then it is the persons fault that got hit because he was standing there, and the same things goes for cars. Go to your insurance company and they should pay for the damage.

  3. The golfer is liable. There are probably signs posted around the range stating that. But, finding the person who hit it would be impossible. It would be cheaper to just get your insurance to pay. It would be the same as being hit by a rock thrown up by another car. They pay if you can find them, otherwise, insurance.

  4. There was a ruling that a road adjacent to a golf course absolves the player from liability. The reason ? Errant shots are to be expected in the game because golfers are not perfect . The shot was an accident and not hit purposely at the car.

Generally it is the golfer that hit the shot since most golf courses and driving ranges have signs posted disclaiming their liability.  However, it is virtually impossible to find the person that did the deed unless the driving range has security cameras.  So... best and easiest solution is have it covered under your insurance.

    Legally speaking, you can sue the driving range in small claims court, claiming that they were negligent and did not put up sufficient barrier, thus caused the ball to fly out of their property and incurred damage.  Signs disclaiming liability could be interpreted as only in their parking lot and there are no signs on the road warning passing by cars.  You'll probably win, but at what cost and time??  Not worth it.

  7. You NEED to go to your insurance company because nobody is liable. Your insurance company should cover the cost of damage. This happened on our course during a school golf meet. A person hit a cars side mirror.  Any way the driver stopped at the club house and the worker said he could not do anything about it.  He said go to the insurance company.
