Question:

My apartment is not worth the amount of rent i am paying and i am being evicted what should i do?

I have a two bdrm apt in WA State. My landlord said our apartment would be ready by 04/04/08 which is the day we moved in. Me my two girls and my mom are living there. We did a walk thru ourselves because the manager never did one. We had a hole in our ceiling that was leaking onto our stove whenever we tried to take a shower. The plumber didn't come until a week later to fix it so we were takin showers at friends houses. Our water runs out a yellow color because the pipes our rusted so we can't drink the water. Our cupboards are in horrible condition and the bottoms were falling out. Under the sink is caving in also upstairs in the bathroom. Our heater covers don't stay on they always fall off, they didn't completely paint our apartment, our closet and bathroom doors our two differnt colors. Theres mold in the windows the dishwasher is over 40 yers old and falls out when you try to open it. Our toilet upstairs is cracked theres so many other issues. i'm being evicted what should i do?

  1. Did you do an inspection prior to moving in?  Why on earth would you move in there after seeing all those problems you mentioned?  You should have immediately called your landlord nad told him you were backing out.  Do you have a singed lease?


  2. As Jane asked, Why did you move in?  Yet that is water under the bridge at this stage.

    You have more rights then he does FYI.

    With that said, you have not stated why the landlord is evicting you, I will venture to say it is because you have not paid the rent.  So you need to first file a complaint against the landlord with the Housing Commission stating in detail why you have not paid the rent and the abhorrent conditions you are living in.  The mold problem alone could easily close the place down.  This will give you time and it will also give you a starting point.  In the end I would just move but you also do not want this on your record for when you go to rent again so make sure everything is documented in your favor.

  3. Why did you move in in the first place?  You always walk through BEFORE signing papers.  Secondly, why are you being evicted?

  4. When you first did a walk though you should have addressed ALL of the things that you say and witin a week from being there you should have had a new list of things that were not right. If the landlord didnt want to comply you may could have broken your lease and took a loss on your deposit. Call you local housing authority and ask them about what can be done. One you are served with eviciton papers there is not really much you can do, but move.
