My apartment lease ended in March 2007, can they hold me to the original lease terms after the terms end?

My lease terms expired in March 2007, per the original agreement I had to give 60 days notice to vacate the unit. After the lease ended, I went to a month-to-month agreement and recently gave my 60 days notice to vacate the unit in June 2007. The landlord is trying to force me to pay the 3 days of rent in July to fulfill my 60 days. However, once you go month to month am I legally only required to give 30 days or can they force the 60 days of the original lease terms that expired over a year ago? Please let me know. Thank you.

  1. I am in CA, a landlord.   You do NOT owe the 3 days rent.

    You reverted to the law for notice, which is that the landlord has to give you 60, you have to give him only 30.


  2. Just curious how you arrived at 57 days if May has 31 days and June has 30 days and you gave notice May 1?

    Anyway, what applies is landlord/tenant laws in your area for month to month tenants.

  3. The answer depends on the landlord-tenant law of your particular State. That said, I THINK that a month to month tenancy only requires 30 days notice of intent to vacate.

    you gave a letter of intent to vacate and did

    3 days shy of 60 days is just a technicality and they are being crappy about it

    show them that you are above their childish pettiness and

    pay the 3 pro rated days for July and let it go

I don't know the law in your state but in my state and surrounding states the law is clear if you are a month to month tenant you have to give 30 days notice unless your lease has a clause that states different.  Read your lease carefully and then confront your landlord.  How much is 3 days rent.  It may not be worth the effort to fight for it.  You can go to small claims court if you have to.  Talk to the landlord and see if you can negotiate something first
