in reference of getting married with an aussiehe is on an E-2 visa.

  1. An E-2 Visa will allow for change of staus in the USA.  You would need to apply for a marriage license, get married and then file the following docs with immigration:

    I-130 - Petition for Alien Relative

    I-485 - Application to Register Permanent Residence or Adjust Status

    I-765 - Application for Employment Authorization (if you aren't already authorized to work whilst you wait for your green card)

    I-131 - Application for Travel Document (Advanced Parole)

    I 864 - Affidavit of Support

    G-325 - Biographic Information sheets

    These can all be filed together at the Chicago Lock box, as your fiance/husband is already in the USA.

    Your (then husband)  will also need to go for an Immigration physical, approved doctors can be found at www.uscis.gov - cost vary from $350 -$500 depending on where you live.

    Each form listed above will also need supporting documents such as Birth Certificate copies, Passport page copies, Tax Returns, Copies of your DL, Affidavits from people who know you and will swear your marriage is real, copies of your marriage certificate and passport photos - this is all explained in the instruction part of the forms. All forms and instructions can be downloaded from USCIS.gov.

    Once you submit everything, you will be sent a notice to have your biometrics (fingerprints and photo) taken at a local support center so they can start an FBI background check on you. Then you just wait for you notice to appear for an interview. If you pass the interview, you will be approved for your green card.

    I applied on Dec 7th for my GC, I had my Employment card and travel permission by the end of Jan, and went to the interview at the beginning of April - everything was handled in Chicago so things might take more or less time depending on where you live. Good luck :)
