He agree to pay compensation but I'm holding company laptop until he make his full payment. How do I write a formal letter for him to agree I'll return his laptop until I receive the payment. Also if he didn't respone asap, I'll bring him to court. The compensation is less that what really worth of my job. He fired me because I did a small mistake, sending him an old file instead of updated one. I didn't cost any damage to the company. I don't think I deserve this. I help him to set up the whole company and with such small mistake he fired me. I wonder if he's taking advantage of me. Can anyone help me with drafting out a formal letter? Thanks!

  1. wow dude, your life sucks.

  2. You can not legally hold his laptop.

If he owes you salary, you may be able to contact the State that you reside.  Or, file a case in Smal Claims Court

  3. if you are in Canada and you have been with the company less than 3 months they can fire you for any reason. however if you have been with the company longer. they need a legitimate reason or can be held liable! check out labor relations!

make sure to give back the laptop so he has no reason to counter sue and so that he is in the wrong 100%

  4. You don't say where you are.  If you are in the US, almost all states operate under something called employment at will, which means you can be fired for no reason, and the company doesn't need to pay you anything beyond your wages for the time you actually worked. If you are in that situation, he could have you arrested for theft of the laptop if you don't return it when he asks you to.
