My boss has fired me because I checked face book while working and made a personal call?

While he does this all the time. He does make personal calls and checks his e-mails, play games and check face book. His excuse was that he works more hours than me while he cannot prove that I work many odd times. For example I came in the morning for 5 hours and then came back to work at 9.00pm until 2.00am in the morning. I work my *** off there. The hotel owners are saying they don't want their GM to quit and will hounor his decision. Can I complaint to Labour Board for this injustice?

You can complain but it won't help,the best thing to do is talk to him and see if you can quit instead of being fired  because being fired will follow you around,how he knew you did those things probably is an invasion of privacy but you did do it on company time,it doesn't matter what he does except I would tell his boss or anyone who can fire him, lie and say he told you as long as you keep it under 2 min. its ok. his excuse for working more is c**p and you should tell him your going upstairs unless he gives you your job back because he told you you could talk on the phone and facebook also. You have already been fired so go in there and try and get your job back,at least get him fired.

    Most companies have a code of conduct.  Playing games, making personal calls and checking face book on company equipment on company times violates this and is grounds for immediate dismissal.

I don't think you would be able to make a formal complaint. work is hard to get these days and if your not trying your best they will most likely fire you. i think the best you could probably get is your boss fired, but why go to the trouble. Why not put your energy into getting a better job?  

  5. You made a mistake.  Have fun on your own time.

  6. File a report with the unemployment agency.  They should say you were terminated unfairly and therefore are entitled to full unemployment benefits.  In most states your previous employer will be on the hook for part of these payments, if you are in the US.

  8. The fact is you  broke policy. It does not matter who else breaks it even if it is a boss.  That is the hole but he does it speech.  The fact he is the boss now if he gets caught by his boss then he can loose his job but untill then you need to follow the rules no matter who breaks them

  11. No sorry dear, They didn't break the law. Actually you did. It's considered time theft, and they could have taken it a lot further than that. But they didn't. You should feel lucky all they did was fire you. It could have been worse. Just go look for a different job, and next time don't do that kind of stuff while you're at work. And you'll be perfectly fine.

  12. No. They didn't break any labor law. It is a private business, and they can fire you for pretty much anything they want, with a few exeptions such as race.

  13. It all depends on the published company policy regarding computer usage.  If the company has a stated policy against the use of computers or their telephone system, or any other part of their infrastructure for personal use then probably not.

    However, should such a policy exist then they should exercise it against all employees no matter their position, if this has not happened by all means speak to a union rep.

    If the company has no published policy as regards personal usage of company equipment (which to be honest I doubt, but I have seen) then you also may be able to successfully argue your case.

    I doubt that the hours both of you work couldn't be proved as I think most employers in that industry (the hotel trade) still require you to clock in when you start and clock out when you finish, therefore they should have a record of hours worked by both parties (This nonetheless doesn't actually affect policy regarding computer/telephone usage (unless there is a separate policy for out of hours working)

    Long and short of it check the company rules/regulations for advice about their computer policy and decide from there about whether you, or your boss are in breach of the stated rules, and THEN decide about whether you should speak to your union rep or some form of legal counsel.

  14. nope bc he makes the rules of what you can and cannot do, personally id fire you if you were doing that and one day youll be at the top doing whatever you want and you dont want your employees on the computer doing nothing while you pay them.  its his job to make sure work is getting done and its your job to do that work. it sucks but thats life

  16. If he was ur boss and he had a reasonable excuse to fire you, then no.

    But you can argue that their wasnt anything stating you arent aloud to check ur personal affairs, but generally speaking he is the boss and he had reason to dismiss you, though it be hypocritical. I think a warning should have been issued. but its common sense to not make personal calls while at work...
