My boss is cybersexing and looking at p**n and smoking in the office. Can I sue?

My boss is cybersexing and looking at p**n using the employer network and at the same time disabled the smoke alarm so that he can smoke in the office. Due to the nature of the work at any given moment there are about 40 little kids within 30 feet. What can be done to stop this and can I sue for sexual harrassment and second handsmoke?

  1. Oh my god. You people and lawsuits. Over second-hand smoke?!? You're ruining the d**n country. And what sexual harrassment? How exactly is this guy harrassing you? Looking at dirty pictures on the Internet hardly constitutes harrassment.

    I keep seeing vicious can I get my boss fired posts of this sort. It never seems to occur to the people who make them that they're talking about someone else's livelihood and career. If the boss were somehow endangering them or really harrassing them it would be one thing, but so far that hasn't been the case. I'm beginning to think that we're raising a generation of vipers.


  2. How exactly is he sexually harassing you by looking at something on his computer (albeit, the company computer)? Explain to me how this is infringing on your freedoms? Lemme guess, you can't find a rich old man to take care of your because you are such a pain in the rear that you have to sue this guy?

    As far as disabling the smoke detector, that's an issue for the building manager. Find him/her and complain and move on with your stinkin life.

    YOU WEREN'T SEXUALLY HARREST LOOK THAT UP IN THE DICTIONARY AND SEE THE DIFFERENT BETWEEN SEXAUL ABUSE AND WATCHING p**n.

  4. Anyone can sue anyone for anything (if they have "standing") ... the question should be what is the likelyhood that you could WIN such a lawsuit and the only person who **might** be able to tell you that is a local attorney who examines your evidence (assuming you actually have evidence).

    Doing these things around kids on the other hand could invite criminal prosecution for child endangerment. Rather than suing your boss you might be smart to talk with the local District Attorney. In fact, if what you are describing is accurate then you **should** talk with the DA to prevent being blamed for contributing to exposing minors to p**n and/or second hand smoke. Go see a lawyer right away, if your boss is convicted on criminal matters then it should be possible to follow that with a civil lawsuit for sexual harrassment.

  5. why would you want to sue. wouldnt you rather notify the appropriate authority to protect those 40 llittle kids!!!!!!  

    I would think maybe Ofsted should be notified

  6. does your boss make a point of showing you his internet content, or are you inadvertently seeing it? its not sexual harrassment if he makes no untoward advances regarding you. is it a state law to not smoke in your workplace? if so then you have an obligation to report his smoking if you have knowledge about it. you can due it anonomously if your chickenshitt about it. (which sounds like you are if all your concerned about is sueing for your own personal gain)

  7. Grrr, another sue-happy trying to make a quick buck when your first real thought should be to report your boss to his superiors.  

  8. You don't want to sue... that will just make your boss angry at you and hurt your chances at advancing in the company.

    If you want to nail that promotion, what you want to do is get on his good side...   Why not suggest something that would appeal to his interests like a weekly "Bring Your Blowup Doll to Work Day"?

  12. You can only sue if you have damages. But, do you have any? Were you or was anyone else harmed? When he surfs p**n in his office is it in plain view, or does he attempt to keep it a secret? Does he make any sexual comments/advances toward you? Has his surfing p**n damaged your job or career? Have you contracted cancer or any other disease as a result of his smoking?

    If you have no damages you cannot sue. But you should report him to his boss and/or human resources. If he is the top boss, and you haven't been harmed, you are out of luck.
