Question:

My boss is insulting me..?

I was forced to work an hour late, and my boss didn't even pay me for it. When I "clocked" myself out like I'm supposed to to get paid at the end of the day, she started swearing and calling me a dumba*s, along with other things. The reason I didn't get paid for that extra hour is because she clocked me out when she WASN'T SUPPOSED TO. Is this right? Should she be allowed to call me all those names for doing my job? Also, I told a friend I was going to quit, and apparently, she couldn't keep her mouth shut, and now, a boss who is higher up in the "tree" is giving me a REALLY hard time at work. Is this right? Should he be allowed to do this? HELP. I need to know what to do!

  1. Call McD's corporate HR.  They will listen to you.

Just state the facts and present your case in a calm professional manner.

    Good Luck!

  2. First of all, its "employment at will".. you can be fired for any reason (so long as it isn't discrimination based on race, s*x, or disability), just like you can quit at any time.

Without getting into all the details and trying to determine the legality behind it... do you really want to go that far for a job at McDonalds???  In order for you to take action, you would need to bring a case up against McDonalds.. they will have a huge staff of lawyers on their side.

If you wanted to get compensation, you would have to file a lawsuit against the company... do you have the time and money to hire a lawyer and go to court for several weeks?

Wether or not its right or legal, its time you chalk it up as a learning experience and move on to another job.

  3. No, that is a lawsuit if your boss calls you any name, discriminating against you. You can also sue for not getting paid for working.

  4. go to you union rep. employers are suppose to treat employees with respect. the boss clocking you out was inappropriate. at the end of your work day you are the one who should clock out

  5. It's not only an insult, it's also illegal.  According to the state's labor laws, they are required to pay you for any and all hours that you work.

    Check out:  http://www.dol.gov/

You can file a complaint with the department of labor, and report them to the Better Business Bureau.

As far as your boss, you can report her to her bosses.  I would do it in writing, and provide specific examples of her behavior.  For example, put it in quotes EXACTLY what she said (spell out the cuss words and everything.)  Let them know what your plan of action is if they do not take immidiate actions to correct her behavior.  What she did can be considered harassment, and is definitely creating a hostile work environment and is very unprofessional.

If your state has a union, you may be able to take it to the union.

Don't let them bully you into silence.  You have a right to work in an environment where you feel safe, are treated fairly and paid for your time.

  6. no she cannot clock you out while you are still working the labor board in your area can be contacted
