Question:

My boyfriend canceled his credit card account over a year ago. Now they are saying he never did and owes.?

They call several times a day saying he owes an annual service fee of 74 dollars. They say, "We have no records indicating you canceled", and neither does he because he did it over the phone. What can he do about the harassment? He won't pay the money.

    tell them to prove it's been open

    has he gotten mail from them since he canceled?

    if it was open and had a zero balance he'd be getting mail from them trying to promote a teaser rate so he'd use it

    if he canceled it with a balance on it for instance. he shut it down because the balance was out of control and he had just quit paying on it, it will fall off of his credit rating after so many years 5-7 depending on the state.the statue of limitations runs out for recovery

    if he sends them money the statue starts all over again it's as if he shut the card down yesterday

  3. Well, if it's your boyfriend vs the credit card company, my money's on the credit card company.

    Shell out the $74 and chalk it up to experience.

  4. Then your boyfriend is stupid.  Tell him to pay the measly $74, and GET DOCUMENTATION FROM THEM THAT HE PAID.  He should have had them send something last time.

  5. Tell you boy friend to go to the relevant financial institution and get a form and cancel the credit card again. Make it clear that this is a repeat of the cancellation that he did one year ago. If you can not get to the relevant financial institution then ask the people ringing you to send a form to you via post in order to cancel the credit card.

    When it is complete, photocopy it. Take it to a justice of the peace and have the photocopied copy verified. This way you have a verified copy of the cancellation so that if any further problems arise in relation to this credit card company you can say "Well, we have a verified copy of the cancellation".

    Seeing as this is your boy friends second attempt at cancellation you should not have to pay the annual fee. However, they may insist that he pays to maintain a good credit history.

  6. He should stop dealing with them over the phone and start dealing with them in writing.

    If there was no balance on the account at the time he closed the account, he should dispute the charge in writing and if he has not used the account in over a year, that would be the best defense and assertion that he did cancel the card a year ago.  

    Another one would be if they haven't sent him any sort of statements in the past year to show that the account was still open (and the probably have not), showing he has zero balance, he can assert that the credit card company did not meet their due diligence requirement to let him know that the account was still open, or he would have again contacted them again to advise him the account was closed.

    He should indicate that if the charge it not reversed and the account closed that he will file a complaint with the Better Business Bureau (BB) and the Attorney General's Office and he should look up the credit card company online at the the BBB and find the corporate address and officer(s) and send a carbon copy of the the letter to them.   He should ask for a response within a specified period of time, like 10 days.  If he doesn't receive a response, he should file complaints with the BBB and the Attorney General in his state and whatever state the company is doing business out of at their corporate offices.
