  2. As long as you're both capable of getting married, sure.

You'll need to apply for an change of status. I gotta admit, I have little experience with B2->F2.  Might be, Immigration would ask you to apply outside the country, but I'm not sure.

Best thing to do is check with a CIS office as soon as possible. What you do NOT want to do is let your B2 status expire before you apply.  You'd be "out of status" and that notion of applying for an F2 out of country would seem more logical.

You probably had a six-month B2. If you're going to marry, don't waste any time checking with CIS/Immigration. Go to their office and remember to take notes. If someone tells you "sure, go ahead," make sure you get their name.

Try not to have your B2 cancelled, since it's good for ten years, and your F2 is only for "duration of status," or as long as your fiance will be a student.

And it might not hurt to find an attorney who can help you.

  3. I'm going to come from out of left field and say yes.

But it may only be legal in America.

I have no clue about the legalities of the issue. But it would seem to me, that you would be able to get married. How legal it is in other countries, how legal it is even here I have no idea.

So I would say don't do it until you get back to your country, because it may not be legal there.

  4. yes, you can get marry and change your non-immigrant status in US. you need to file Form I-539 application to extend/change non-immigrant status to USCIS. the filing fee is US$300. you will need to submit the application with your original  valid I-94 arrival/departure card; copy of your husband's I-20 form; copy of your marriage certificate; copy of your passport; and Form I-134 Affidavit of support.

As soon as you get your marriage certificate, you can file your application at the USCIS service center that has jurisdiction over your residence. the processing time depends on which USCIS service center you file your application. good luck.

current processing time for TSC is 06/13/07.

current processing time for NSC is 05/12/07.

current processing time for CSC is 09/16/07.

current processing time for VSC is 06/18/07.
