Question:

My boyfriend is a British Citizen living in America. I am British. He has a green card - can we marry?

He has a green card - has been living in Canada and Usa for total of 21 years. He has 2 children with Canadian ex-wife. We want to marry and live in the US. He set foot on American soil coming up to 5 years in March 2009. He can then apply for citizenship. Can we marry then and is it likely we will have to go through a load of questioning - or will I be allowed to stay permanently? It is all very confusing.

  1. The guy above me is wrong.  Now you stated that you intend to marry, the US can stop you from entering.  You need to apply for a Visa to marry.  You will be interviewed at the Embassy in the UK, and have a medical.  After you enter and marry you then again have to file for an "adjustment of status" then 2 years later you have to apply for a 10 year perm.resident card.

    Whatever you do dont go to the US if you intend to get married here without a visa, you will really pay more then you could imagine.


  2. you can get marry whenever and process your petition after he is a U.S Citizen otherwise he can do it as a resident but it will take years for you to get your papers if he does it as a resident and if he is a citizen just months for you...  

  3. Yes, you can get married.  However, you cannot get a visa to live in the United States for about 5 and 1/2 years.

    If he were a US citizen he could get you a visa in about a year, maybe less.
