My boyfriend is a convicted felon and he is trying to get custody of his daughter. What does he need to do?

His was convicted of a drug charge and spent 2 years in prison. He has a job and is doing very well for himself now. We plan to get an apartment together soon and I think that his daughter would have a better life with us. Please let me know what we need to do get custody of his daughter.

  1. First of all gather all evidence that you two would be good parents and could take care of child together and then take it to court.


  2. well i would like to know why you think she would have a better life with you. i hope it is not selfishness. if the mom is not a good parent that is one thing, but if she is a good parent, you are doing more harm by trying for full custody andit is better to share custody. this type of thing is traumatic for a child, and by the way, children dont like "girlfriends" trying to pretend to be their mommy. however if mom is not a good or stable parent then he can seek custody by seeking a lawyer that specializes in this case. but please, you and him, put your personal feelings aside, and if she is a good mom, dont put the child through trauma. try for shared custody. a better life, you may think you are giving, but children need their mommies (their OWN mommies)blessings

    Okay, boo to the people who were so rude to answer the question without hope.

    I personally know it can be done, I have seen this done a MILLION times before. I work in a all males prison, I've seen men that have been down for very VERY serious crimes and still win custody of their child/ren after their releases. I do not know what they do outside of contacting a lawyer and proving that the other parent is an unfit choice to be raising thier child. Everybody makes mistakes, working at a prison has tought me to understand that. A lot of those people in there are good people that did the SAME thing millions of people do, but just had bad luck and got caught. I think prison makes some people a much better person, whereas others learn nothing from the punishment.

  6. If there is nothing wrong with the mother (no legal convictions, no drug problems, etc) why would you want to take a child away from her? If he has truly grown up and put his past behind him, he needs to be grown up enough to think about what is best for his child: the woman who she has known her whole life or someone who has been absent and in jail for years and his girlfriend?

    But from a legal perspective, no court in the land is going to give a convicted felon with drug charges and no place to live a child who has a perfectly stable home.

  7. The first thing he needs to do is contact a lawyer.  It's very important to have a good one when it comes to custody battles.  I for one believe that people can change and turn their lives around, and hope that is the case with your boyfriend.  Good luck!
